Yes, Terri Alvillar was married on October 30, 2010 so I would assume
the other man at the courthouse was her husband. In her wedding
picture she looks to be at least 20 years older than her Facebook and
real estate website photos.

Speaking of Facebook, has anyone seen Mike's Facebook photo? He's
using a picture of Saint Francis, same one shown here...

Mikey is busy drinking this beer, since it combines his love of mountain
biking with cutting down trees to make a tree fort:

All I ever see on RBS these days are the idiot posts of TM. I never read
them of course, I just delete them.

With regard to humor, Tom Sherman is Samuel Langhorn Clemens compared

Mr. Sherman's humor is juvenile and that is the type it appeals to. My humor

It was a mistrial.

<http://peterfrickwright.com/trial/>

So now they start over, but the case goes to the back of the line, so it
could be a while.

What was interesting is that it was finally revealed that the defendant
was offered a plea bargain of 120 days in jail and he turned it down.

On the surface it seems like an open and shut case since no one seems to
be denying that the attack took place. But just one sympathetic juror
who believes that the attack was provoked by the mountain bikers riding
on a road signed for no bicycles could cause another mistrial. After a
few mistrials the D.A. will give up.

This whole affair is nothing but a tempest in a teapot. Just to know any
single mountain biker is to detest the entire species. Bruce Jenson is
finally coming around to a correct appraisal of the situation. After all, he
tells us he does NOT drive his jeep off-road, only on roads however
primitive that already exist. He is to be credited with that much common

I have to laugh! Mr. Sherman is absolutely correct. That is what I like most

Eventually Mikey's going to run out of money to pay his lawyer. I
think after the second trial so long as he isn't acquitted he will
take the 120 day plea bargain.

If he's found guilty then he doesn't get to take the plea bargain. If
it's another mistrial or a hung jury then he's got to hope that the DA
tires of the case and doesn't keep trying for a conviction. I think the
potential for a hung jury is pretty high because the defense only needs
to get one bicycle-hater on the jury.

In any event he's really already lost because a) UC can still ban him
from their land no matter what the outcome of the trial (Strawberry
Canyon and the East-West fire road where the incident took place), b)
he's spent a lot of money on lawyer fees, and c) he's already spent some
time in jail, and that jail is a very unpleasant place.

He's certainly learned his lesson and will not repeat the (alleged)
behavior that got him into all this trouble. Let's be happy for that.

He means "one mountain bicycle-hater" of course. Ride your bicycle on ROADS
and no one objects except possibly some motor vehicle drivers.

All of the above is nothing but sheer conjecture of course ... or is it
wishful thinking?

Mr. Vandeman will continue his crusade against mountain biking on hiking
trails until the end of time. And I and other folks with brains in their
heads will be here to support him. Let's be happy for that!

Oh I doubt that. If the legal system doesn't stop him now, my guess is he'll
move on to something "bigger and better".

I wonder how many 30 round clips he can stuff in his pockets.

Nope, you can't. If you could you would realize that anyone who blathers

I'm sorry Ed, but I've been reading this newsgroup
for quite some time. If Mr. V would keep his "crusade
against mountain biking on hiking trails" to just that
I, and many of us would have no quarrel at all with him.

What irks us is that his crusade is really against
all mountain bikes and people who ride them. You,
except for your unreasoning admiration for Mr. V
seem to be fairly reasonable on this subject.

Hmmm... Good point. I hadn't thought of the BFC analogy, though I've had quite a

So if you want to get into a philosophical discussion.

I also see the world going to hell. But the future I see is quite
different from seeing those who would put all of nature into a
recreation park. Here's what I see. This was written in response
to a friend of mine inviting me to joint a million people all
having the same thoughts (a new agey kind of thing) about peace
and equality of all people to take place on November 11 of last
year. Also, while I'm not particularly a believer in Abrahamic
religions, I was raised in the traditions so I know the
literature. I also live in a beautiful place as I suspect that
you do also.

----------------------Begin quoting myself:

A proper response requires a book. I may write it someday but not yet. I
may leave it for someone else to write.

A million people is a drop in the bucket.

I have a great problem with the transmission of psychic energy as
proposed by mystics.

Nobody really wants to change the status quo. They just want it to
pertain to more people. And that's the problem.

There is a passage in Matthew
25 “Therefore I tell you, do not worry about your life, what you will
eat or drink; or about your body, what you will wear. Is not life more
than food, and the body more than clothes? 26 Look at the birds of the
air; they do not sow or reap or store away in barns, and yet your
heavenly Father feeds them. Are you not much more valuable than they? 27
Can any one of you by worrying add a single hour to your life[e]?

28 “And why do you worry about clothes? See how the flowers of the
field grow. They do not labor or spin.29 Yet I tell you that not even
Solomon in all his splendor was dressed like one of these. 30 If that is
how God clothes the grass of the field, which is here today and tomorrow
is thrown into the fire, will he not much more clothe you—you of little
faith? 31 So do not worry, saying, ‘What shall we eat?’ or ‘What shall
we drink?’ or ‘What shall we wear?’ 32 For the pagans run after all
these things, and your heavenly Father knows that you need them. 33 But
seek first his kingdom and his righteousness, and all these things will
be given to you as well. 34 Therefore do not worry about tomorrow, for
tomorrow will worry about itself. Each day has enough trouble of its own."

There is also Daniel Quinn's retelling of the Genesis story of Eden and
Cain and Abel.

Humans have an animal nature. When, also being self-aware, they decided
that they could circumvent that nature all hell broke loose
(literally/actually). We survived several million years with "enough".
The release from that concept created both its opposite and its
culmination, poverty and wealth. Poverty is "not enough" and wealth is
"too much". Having not enough causes an individual to want more. Too
much causes an individual to want more. Those with too much also have
power. Power is the invention of the poverty/wealth dichotomy.

To change the human paradigm we must re-define the concept of "enough",
provide every human on earth with that, no more no less. It's possible,
the concept of poverty/wealth has only been with us for maybe 12,000
years out of several million that we've been here.

That being said, a million people thinking the same thought is not going
to change anything. There are what, almost 7 billion people on Earth?
And growing? Most with not enough? It's not going to change given our
current political atmosphere any where on the globe. That many people is
an unsustainable number. There is no way that many people will ever have
enough. It's not possible.

Technology won't do it either. There will be a population tipping point
and it will crash. This will change the paradigm. Whether we like it or
not. When will this happen? I don't know. Technology is keeping us
afloat for the nonce, but it won't continue forever. It will crash.

You and I can take heart that we won't see it. We will finish our lives
in a place of beauty with enough. Our kids? They may be in danger but
probably not. Our grandkids are getting closer. A hundred years? Maybe,
or a thousand years. My prediction is somewhere between the two.

Now there will be survivors. Those who recognize the probability that
there will be a population crash should be quietly developing survival
skills which will work where they are now. The need in many areas will
be to learn a subsistence form of farming which will allow small groups
to survive and prosper with "enough". There needs be no "cash crops" or
other forms for trade, there won't be any.

Learn "enough". Throw out anyone who claims to speak for God, either as
a political leader or a religious leader. Tend your garden, love your
family, respect your community and obey the law of nature.

I'm another cynic/pessimist.

But I temper it with the story about the inventor in the 1800's
that supposedly committed suicide because there was nothing left
to invent.

The elites have plans to survive, while most of the "worthless eaters"
(the other 99%) die off. That is why those with real power are doing
nothing to stop global climate change or ecological depletion.

Well, if the "worthless eaters" die off, there will
be nothing/no one left to exploit. Who takes out the
trash, for instance.

I don't see it that way. The elites will die off
as quickly as anyone else, especially if they don't
have any survival skills, like farming, AND there
won't be anyone left to do it for them.

I agree! The future looks grim. Glad I won't be here to experience it.
Instead, I will be resting peacefully in the local cemetery.

Yo have surely got that right VtSkier!

It is no fun being rich if you do not also have power over others. In fact,
liberals-socialists-communists would rather have power over others than be
rich. That is how it has played out everywhere it has been tried. But try to
convince Tom Sherman of that. Nope, it can't be done because he is an
ideologue. It is one of the worst diseases that the human mind is prey to.

Mr. Vandeman and I are convinced that mountain bikes have no place on hiking

The elites :-) I love the smell of a good conspiracy theory in the morning.

There isn't much we can do about the global climate change. Mother Nature
and all that. Slowing the population growth is the only solution to
ecological depletion. Figure out a way to stop every third world country
from ****ting out so many kids and you will have accomplished something.

The alleged incident did not take place on a hiking trail, it took place
on a fire road that is signed for no bicycles. There's a big difference
actually. A lot of private land owners that permit public access put up
such signs for liability protection. Without such signs, someone gets
hurt and can claim that the landowner did not warn people about the
condition of the roads.

Vandeman's goal of protecting wilderness has merit. But he's so
_incredibly_ confused about the relative impacts of different activities
on wilderness. Every study on the subject has shown that the impact of
mountain bikers is not any more than the impact of hikers, and less than
that of equestrians, and actually the mountain bike impact is often less
than that of hikers. Vandeman should be redirecting his time and energy
into campaigning against snowmobiles and other motorized off-road vehicles.

The reality is that hikers often make trails unpleasant for use by
mountain bikers and vice-versa. They have to learn to share somehow.
Scheduling some days for each group of users would be fair. It's not a
question of who was there first.

I agree that Vandeman's actions may hurt the cause more than help.

Where did your find studies of mountain bike impact on the environment? My
observation is that bicycles cause more erosion than foot traffic and the
number of cyclists doing trail maintenance is far less than the number of
hikers doing trail maintenance.

FYI, if you're wondering where the beginning of Vandeman's obsession
with MTB's came from, it was due to a single encounter with MTB riders
on a trail Vandeman was hiking on in the early 1990's. Combined with
his failure to generate any interest in his anti-automobile positions,
and his generally obsessive nature on any environmental topic, he
latched on to this as an "early adopter" against MTB's. He's not
interested in the impacts of equestrians or off-road vehicles, because
in those areas, he doesn't seem himself as a pioneer and a leader,
because many others were ahead of him.

BTW, one of the things that I had to laugh about when I saw Peter's
blog about his defense opening statement is how the attorney
emphasized his employment with Pac Bell for 20+ years as an example of
what a stable citizen he is. Every time we confronted Vandeman with
the fact that his employer destroyed miles of habitat and killed
thousands of trees (telephone poles) and caused far more damage in
California than all MTB'ers combined, he would dodge the issue by
saying "You don't know where I work!". Well, Mike, now that it's
public record, I guess it's time for you to answer those questions we
posed so long ago.

I'm not holding my breath.

Having lots of kids in a third world country is
Social Security.

You have lots of kids so that at least one of them
will take care of you in your old age.

Mountain bikers need their own trails. They ruin hiking trails as Mr.

Easy answer. These third worlders need to decrease the number of offspring they
generate, and increase their efforts to illegally immigrate to the US. :-)

based in reality.

The traditional answer in developed countries has been social
security, pension plans, and child labor laws.

In some countries, kids earn a net return from a very young
onwards - and it makes sense to have more of them.

In other countries, they're a financial liability right through
their teens and even later.

As already observed, with no pensions or social security, kids
constitute one's only retirement plan.

Somebody, somewhere observed that - with or without "birth
control" technology - people all over the world manage to
regulate their families so that the number of offspring is
rational in their immediate contexts.

That may be a misleading statistic.

Now, I have no idea if this is true or not; but suppose cyclists did only 30% of
the maintenance while hikers did 70%, and that cyclists constituted 15% of the
trail's users, while hikers constituted 85%.

If so, that would mean the average cyclist did 2% of the maintenance, while the
average hiker did about 1.2% of the maintenace. In other words, the average
cyclist would be doing almost twice as much maintenance as the average hiker.

Or, playing the game from the other side, maybe cyclists as a group do less
trail damage than hikers because there are less of them.

Ya gotta be careful to present the complete statistical picture. :-)

The BFC people might do better if they realized the animal in question
is a bison, and not a buffalo.

I've not seen formal studies, but in Scotland I've seen plenty of
walking-only trails that have degenerated to meandering quagmires that
blot the landscape and have necessitated remedial action (e.g., the
Schiehallion path and Glen Brittle to Coire Laggan).

I've not been on any trail that has obviously been ruined by wheels.

I see evidence of volunteer trail maintenance from across the board.

Pete.

That's got to be a regional thing. Soil type, cycling/hiking
populations....

Quite a few people do both. I think it might be difficult to figure
out exactly what the proportions are. I haven't gone mountain biking
in years, but the sense I get are that quite a few mountain biking
organizations are active in trail maintenance activities. They might
not be doing so with mountain bikes in tow, so how does one know?

The mountain bike trails I know of in my area are mostly hard-packed
fire and maintenance roads. Their maintenance was mostly by the local
land agency. I remember hiking on one trail that was difficult enough
on foot, but would have been crazy on a bike. It was signed for multi-
use including bikes. The whole trail had been turned into a moonscape
by dairy cattle grazing in the area and stepping on the trail after
rains.

They're trying to communicate to the majority of people (like Ed) who
still think it's a beefalo or a bufflecow or some such silliness.

Man, ain't that the truth. The cows do orders of magnitude more
damage than bikes and feet combined.

I am opposed to cattle grazing on the National Forests. God Damn ranchers
are even worse than mountain bikers I must admit. Read Edward Albee to get a
clue about this problem in our American West.

Well, at least beefalo is a proper term:

And of course, the government leases public land to ranchers at *less*
than market rates, and then allows them to kill wolves and cougars [1].

Yes, I noticed that! Very strange since Google Groups has more or less
