Reposting from MTBR...

"30 days, to be served on the sheriff's work detail (picking up
trash). No actual prison to be served, if the Sheriff takes him. The
program costs some money, too. He also gets credit for having been in
custody for 7 days. Judge said picking up trash was a good plan for a
passionate environmentalist like MV.

Has to stay off the UC trails for 3 years.

DA asked for 270 days.

Judge said that since MV didn't have a record and no one was really
hurt, lighter sentence was appropriate.

Apparently, MV sent a letter to the judge, which the judge returned,
unopened to his defense counsel this morning. Defendants aren't
supposed to send letters about sentencing to the judge without their
counsel's approval, but MV did anyway."

Hell Bells, those of us who respect the environment are always picking up
other's trash anyway.

UC is as ****ed-up as the whole state of California.

The mountain bikers are the ones who should have been on trial. An
appropriate sentence for THEM would have been a good horsewhipping.

No one understands the intricacies of legal procedures, not even lawyers.

I've been picking up trash on trails for years. Do I get credit for that
somehow? I would not call MV a passionate environmentalist. What he does
hurts the environment far more than it helps it. A misguided, wannabe
environmentalist, would be more accurate.

A 3 year trail ban is rather short. Of course UC can ban anyone they
want from their trails for as long as they want, should they so choose.

Yeah, that's not an unfair sentence, given the cost to the state of
keeping someone in custody.

Sheriff's Work Alternative Program (S.W.A.P.)


It is the intent of Sheriff Gregory J. Ahern to maintain the highest
standards of public confidence, credibility and public safety when
implementing alternatives to confinement programs. Participation in
the programs shall occur only when the Sheriff concludes that a person
meets the specified criteria.

The Sheriff’s Work Alternative Program is an alternative to
confinement where participants perform eight to ten hours of work in-
lieu of one day of confinement in jail. The programs intent is to
provide the qualified, low risk offenders an alternative to paying
large fines or incarceration. The sentence may not be over 30 days.

Participants are assigned to work at one of thirty contracted public
agency work sites within Alameda County.

APPLICATION PROCESS:

You must be referred to the program by the sentencing court.

A non-refundable $65.00 administrative fee is required and an
additional $12.00 for each day assigned is calculated at the time of
your first appearance and is paid in full at the time of your second
appearance.

A mountain biker and an environmentalist are mutually exclusive and an
oxymoron besides. It is only we hikers who have any respect for mother
nature. The rest of you are all slobs!

I have advised Mr. Vandeman not to waste his time arguing with idiots on

Mr. Vandeman is too much of a gentleman for Usenet. I am better suited for
these forums since I don't care a fig about being a gentleman. Unlike Mr.
Vandeman, Ed Dolan the Great knows how to get as low down and dirty as the
