QUOTE:
SHOCKING footage has emerged of a driver apparently deliberately mowing down a cyclist who then chases him down the road and smashes in his back window.

The video shows a black Volkswagen Golf driving down the road before it suddenly veers towards the pavement.

A man cycling down the road then leaps off his bike and attempts to run out of the way of the motor.

But the cyclist doesn't manage to evade the vehicle and is hit by the car flipping head-over-heels over the cars bonnet and smashing into another car parked in a driveway and landing on his back.

Immediately, the man struck by the motor leaps to his feet and picks something up from the ground and chases the car which appears to have stalled momentarily.

Clad in a black hat, grey hoody and black jogging bottoms the cyclist catches up with the car and smashes the rear window with the object he picked up from the pavement."

If he didn't go to the police straightaway, he'll have his reasons.

There'll be more to that case than meets the eye.

Whatever the full story may be, you still can't just see someone on
the pavement you have a grievance against and take the opportunity to
run them over with your car. Even if that someone is illegally cycling
on the pavement.

No surprise, then, that the driver has been "charged with suspicion of
attempted grievous bodily harm (GBH) with intent".

Absolutely agreed. But how can anyone be 100% sure, beyond all
reasonable doubt, that that is what they are seeing? Unless and until
the other party comes forward, you can't be. And why on Earth would the
other party not come forward?

> No surprise, then, that the driver has been "charged with suspicion of

Actually, that is surprising to an extent.

How will the police know - let alone prove - that it wasn't an elaborate
hoax: a script acted out on the streets (especially given that it was
conveniently captured on video), unless the "victim" comes forward?

It's no worse than knifing them because they ****ed your wife etc. Using your car instead of any other weapon makes no difference.

If the driver had used an automatic, he wouldn't have stalled, and he could have got away with it.

I must admit the thought that this incident may have been a hoax never
occurred to me. But would that cyclist have put his life in danger to
that extent for a laugh? Notice how he hesitates slightly from getting
revenge on the car when someone briefly emerges from the passenger
side, it was as though he wasn't quite sure what was happening, i.e.
not planned, and he needed an instant to reassess the situation before
proceedings to go after the car.

Also, had it been a spoof, I would have expected the driver to explain
(and prove) as much rather than face a much more serious charge.

You must surely be right, however, about the unlikeliness of this
incident being a random unprovoked attack on a cyclist by a driver.

I don't know whether it was a hoax or not.

But that seems more likely than a random unprovoked murderous attack on
the cyclist.

And remember the recent Australian case (an actress dubbing audio onto
dash-cam footage) which caused the usual suspects here to sagely agree
that this was a clear case of unconscionable "road rage".

Yes, attacking someone you have a grievance against with a car is no
worse than doing so with knife.

>Using your car instead of any other weapon makes no difference.

Yes, if it achieves your objective.

The point I was trying to make is that if you break the law,
mitigating circumstances do not justify or excuse your offence (even
though they may reduce the severity of the charge).

They can reduce it to zero if it's self defence.

1) You attack my wife. I grab the nearest blunt object and hit you over the head with it to prevent you from continuing, and you die.
No charge.

2) You attack my wife. She tells me you did it when I get home from work, so I go round your house and beat you to death.
Reduced sentence.

3) You don't do anything, or perhaps let your dog **** on my lawn, or something fairly trivial. I go round your house and beat you to death.
Full murder charge.

That will be the case if you have acted lawfully and in self defence.

Assuming it can be ensured that you have acted reasonably and in good
faith, you can defend your wife and not be prosecuted for such action.

An elderly British gentleman of 83 arrived in Paris by plane. At the French
customs desk he took a few minutes to locate his passport in his carry-on
bag. 'You have been to France before, Monsieur?' the customs officer asked
sarcastically.
The elderly gentleman admitted he had been to France previously.
'Then you should know enough to 'ave your passport ready,' the customs
officer said. The elderly gentleman replied, 'The last time I was here, I
didn't have to show it.'
'Impossible! The British always have to show their passports on arrival in
France !'
The Man gave the Frenchman a long hard look. Then he quietly explained;
'Well, when I came ashore on the Beach on D-Day in 1944, I couldn't find any
****ing Frenchmen to show it to...!!

I said to keep your fingers crossed here because your claimed for
mitigating circumstances still have to be accepted by the powers that
be and they might not see things the same way as you do.

Exactly the point I was attempting to make from the outset: "if you
break the law, mitigating circumstances do not justify or excuse your
offence (even though they may reduce the severity of the charge)."

I am not basically disagreeing with you anywhere.
