Driver gets year ban for hitting cyclist
QUOTE:
"A DRINK-DRIVER who knocked a cyclist off his bike and injured him has been banned from driving for a year. Kevin Thomas Wallace McKernan, 34, was driving along James Street at 7.30pm on November 24, when he collided with a cyclist and knocked him off his bike, said Martin Butterworth, prosecuting at York Magistrates Court. The cyclist suffered bruising and a broken wrist. McKernan gave a breath test with a reading of 48 micrograms in 100 millilitres of breath. The legal limit is 35. McKernan, of Kennedy Drive in Haxby, pleaded guilty to drink driving and was given a 12-month driving ban, and ordered to pay a £100 fine, £85 prosecution costs, a £20 statutory surcharge and £150 court costs. He represented himself and said he was "deeply and genuinely remorseful" for the collision. "I believe the cyclist was at fault," he said. "He signalled as he moved out to the right. I gave him a minor bump." He said he had immediately pulled over and stayed with the cyclist until the police arrived. McKernana said he had been drinking into the early hours the night before and mistakenly believed because he had slept he had been under the limit." http://www.yorkpress.co.uk/news/1414...ff_his _bike/ |

"...a 12-month driving ban, and ordered to pay a £100 fine, £85 prosecution costs, a £20 statutory surcharge and £150 court costs" is basic, par-for-the-course, stuff for a breathalyser offence. So there was, in fact, no measurable penalty for the collision with the cyclist. The text of the report may go some way to explaining that, of course. |

Liverpool University have spent £900k on a study, showing that early humans mated with Neanderthals. I could have saved them £900k of that just by watching cyclists. -- Dave Dedicated to finding a cure for cycling. |
