Default Cycling on footpaths. Is now OK


The new Countryside Code says that you can, so long as you give way to
walkers and horse-riders. No mention of this just applying on bridle
ways, which used to be the case.

Most recent edition of the Highway Code, Rule 54, still says you *must not*
cycle on the pavement. Sec 72 Highways Act and Sec 129 Road Safety Act. Have
these been repealed then?

Not the same thing as footways adjoinng roads, I think.

Just gone to official new code site, and same old rules apply. No cycling on
footpaths without owners permission, then give way rules apply.

I would think that the term 'footpath' is being used in a very general
way to mean off road paths in general.

There is no legal right for cyclists to use a footpath. However, the
law relating to riding on city 'footpaths' (technically footways
alongside a highway set aside for the use of pedestrians), including
the use of 'Fixed Penalty Notices' does NOT apply to country paths
where there is no road alongside. A cyclist might be technically
trespassing but this doesn't mean much as long as no damage is caused
to crops or similar.

A cyclist using a country footpath might still fall foul of local
bye-laws. For example, The Peak District National Park Authority has
always had a tradition of being anti-cycling and has used its powers
under the 1945 National Parks Act to make cycling on anything other
than a bridleway or road a criminal offence carrying a fine of upto
£500.

A pavement is not (normally) a public footpath (which has a
specific legal meaning). So it's not relevant.

True, but there's no "legal right" to cycle (or indeed drive) on the
roads either AFAIK.
