Road rage cyclist in court, because someone hooted him
James Bromet, 51, attacked Robert Jackson with a metal D-lock after the motorist got out of his Alfa Romeo to protest about the damage to his vehicle. The altercation began when Mr Jackson beeped his horn to avoid a collision with Bromet. The cyclist shouted and swore at the driver, saying “I’m going to hit your car” before taking the cycle lock and smashing the car’s bodywork. When Mr Jackson got out of his car to try to restrain Bromet, the enraged publisher attacked him with the lock. A police officer witnessed the assault and arrested Bromet at the scene in Hammersmith in August. The cyclist, who later apologised for the attack and said he was “mortified”, admitted assault, causing criminal damage, and using threatening words to provoke violence. Bromet, of Fulham, said in a police statement: “This car came up behind very aggressively, tooting, obviously taking offence at something, but it didn’t stop, and came up behind us again. It was then that I reacted badly.” Magistrate Greg Thomson said: “This is a road rage incident where the defendant, for whatever reason, not only chose to use a lock to damage the victim’s car, but has then taken a swing at the victim. It seems blatantly obvious that the police halfwit arrested the wrong party - the use of the motor vehicle to assault the cyclist (assault includes any act which causes the victim to fear immediate and unlawful violence) gave the cyclist the perfect right to defend himself against such aggression, and the abuse of the horn only reinforces that this was a deliberate act of "get out of my important way, pleb". It's unfortunate that the cyclist will end up with a criminal record due to the perjury of the police officer and his assailant, who seem to have conspired together to pervert the course of justice. I note that the victims statement was uncontested, although I dispute that his reaction was bad - only the police reaction to his self-defence - so it seems that he was under some duress while making his statement. I was only joking - I wasn't really expecting him to come along and defend the psycholist's actions. But hey - what a bonus! |

Brilliant load of crap from Phil, he never disappoints in his amazingly bad prognostications. On a legal note, reacting some while after the event (as in this case) would not be considered to be a provoked/frightened reaction. It would be a premeditated act of violence/vandalism. The logical thing to do is to stay as far away from the perpetrator as you can, not move closer for vigilante action, by all means take the details and report the alledged misdeed. |
