Cyclist jailed for pavement death
A cyclist who knocked down an 84-year-old pedestrian who later died has been
jailed for seven months.



Darren Hall, 20, cycled down a hill in Weymouth, Dorset, too fast and rode
on to the pavement to avoid a red traffic light, Dorchester Crown Court
heard.

As a cyclist terrorist he should have been banned from riding a bike
for the rest of his life.
His bike should have been crushed.
Obviously the judge was a cyclist & gave him a leinient sentance.
The police & the CPS are also obviously cyclists, he should have been
charged with manslaughter.

I find it a bit weird that he was prosecuted for a _driving_ offence.
Obviously it was felt that in order to treat him as leniently as a driver
would be in the circumstances, it had to be so.

The guy should have got longer IMO. Just like all the motorists who
mow down hundreds of pedestrians each year - I don't make a
distinction.

The thing is, many drivers who kill people in HIT-AND-RUNS get more
lenient senteces:

I find it a bit weird that he was prosecuted for a _driving_ offence.
Obviously it was felt that in order to treat him as leniently as a driver
would be in the circumstances, it had to be so.


It's a /driving/ offence but not a /motoring/ offence; it relates to
driving any sort of carrage - including a bicycle. The clue is the
fact that the law predates the invention of the motor car.

What gets me is that he was not prosecuted for manslaughter, which
would seem a much more appropriate charge in this case and carries
with it a much more appropriate sentencing options.

And it also (apparently) is a crime against the person, rather than the
laws of the road:

"The wanton and furious driving charge goes back to 1861 under the
Offences Against the Person Act and reflects the gravity of the
incident."

I think so. However, perhaps it was felt that a manslaughter charge
wouldn't stick.

I think that the rather mild sentence shows that the tendency in law to
discount injuries when caused by drivers of vehicles - of every kind -
goes back a long way.
