Cyclist jailed for pavement death
A cyclist who knocked down an 84-year-old pedestrian who later died has been jailed for seven months. Just like all the motorists who mow down hundreds of pedestrians each year - I don't make a distinction. And much less chance of a jury finding him guilty? The CPS will pitch for what they think they will get , rather than what the offence is worth, they do this at both ends of the scale. |

And it also (apparently) is a crime against the person, rather than the laws of the road: "The wanton and furious driving charge goes back to 1861 under the Offences Against the Person Act and reflects the gravity of the incident." What gets me is that he was not prosecuted for manslaughter, which would seem a much more appropriate charge in this case and carries with it a much more appropriate sentencing options. I think so. However, perhaps it was felt that a manslaughter charge wouldn't stick. I think that the rather mild sentence shows that the tendency in law to discount injuries when caused by drivers of vehicles - of every kind - goes back a long way.
