Default Cyclist sentenced for bashing woman driver

Now he has been convicted she should be able to sue for compo. I hope he
had fridge-freezer insurance at the time.

Was this 'one punch lycra man' ?

Default The Ride Journal Issue 6 imminent, party time Friday

QUOTE:
The latest issue 6 of cycling magazine The Ride Journal has gone to
the printer which means it will shortly be on sale at stockists and on
their website. As usual after such a gestation period - production is
on a roughly nine month cycle - they're ready for a party and this
will be happening at London's Look Mum No Hands on Friday. We're all
invited and there will be copies of the new issue available to pick
up.

There's nothing like the pleasure of seeing a magazine finished and
knowing you can go to the pub before it all kicks off again. With a
nine-month build-up that's quite a thirst and when the production
values are as high as they are for The Ride Journal you can be sure to
be meeting a very relaxed team on Friday assuming they get to hear the
'thump' of the delivery driver's fresh-boxed copies later in the week.

According to Editor Philip Diprose, there will be 200 pages this time
and his potted synopsis for issue 6 goes:

"We’ve got riders in the cold, from Alaska to Oslo. Riders in the heat
from Nullarbor desert to Mallorcan mountains. Absolute beginners
through to weekend warriors. Plenty of pro-riders a Guinness record
holder, a world champion and even an Olympic gold medal winner. Pieces
to inspire the head, the heart and the legs of every type of rider.
Whether you are a seasoned rider of new to the game, big wheeled,
small wheeled, dirt, track or tarmac. Hell we’ve even got a rider
being chased by a police helicopter."

Also appearing in Issue 6 will be work by road.cc's own and long-
standing MBUK 'Mint Sauce' creator Jo Burt, illustrating a piece by
author and Guardian journalist Max Glaskin on getting back into
cycling after years off his bike.
What we like apart from the writing, the design, the illustration, the
photography and the paper is the sheer breadth of subject matter and
flicking back through our own first five issues there are themes as
diverse as documenting broken bones - that's a funny article - to the
artist Grayson Perry on cycling tribes which is less amusing, more
wistful.

Especially good is The Ride Journal on touring; the various
contributors have been everywhere by bike and never fail to make us
question why we're squinting at a computer screen instead of being
intrepid somewhere in the open air.

Even the advertisements are worth reading - it's the cycling
equivalent of flicking through 'Vogue' where quite clearly most of
them are put together specially for The Ride knowing it's a
prestigious gig. Does that worry you? Don't. Editor Diprose is
practical and healthily bikie-like, "I think we’ve got something for
most people."

The cover price per issue is £8 although it will be £7 on Friday.

Hmmmm.

"Davidson's defence solicitor, Robbie Burnett, told Sheriff Neil
Mackinnon that his client had received injuries himself, including a
broken nose, when he was knocked off his bicycle.

He said: "Clearly he was provoked in this situation and made the
mistake of engaging with the complainer instead of contacting the
police. This was a momentary loss of control, but understandable in
the circumstances.

"The difficulty I have and Mr Davidson has, is the fact that the
complainer has not been prosecuted in any way. Quite clearly what
happened was either assault or dangerous driving."

Mr Burnett said other witnesses saw the cyclist come out the underpass
and indicate before joining traffic. They claimed the car had not let
Davidson in at first and when they did, they "deliberately swerved and
knocked the cyclist off his bike".

The lawyer said another witness claimed: "The red Golf did not slow
down. She honked her horn and the cyclist turned round. The red Golf
swerved to the left for no apparent reason and knocked the cyclist off
his bike. He came tumbling off onto the road.""

Deserves what she got then.
She won't be doing it again - that's for sure.

So the cyclist tried to force the car to give way and fell off or was
knocked off in the process?, does that justify, in any way, battering a
woman to the stage of permanently disabling her? IIRC She was sitting in
her car when the vicious attack occurred, and the cyclist was described as
of 'athletic build' Why did the cyclist not wait for the Police, nor call
them himself? It is just a great pity that other drivers did not detain him
at the time.
Since the woman was not charged with any driving offences it seems likely
that there was no damage to her car to support any allegation that she
knocked him off.

This was another example of an arrogant cyclist thinking he could get away
with bad riding and assault due to his anonymity.

The fact that she honked her horn was indicative that it was not a
SMIDSY, but a deliberate assault.
I hope she was insured - compo time backons.

"The fiscal said Ms McKain claimed she had not deliberately hit
Davidson but other witnesses said the car swerved towards him."
Why would they say that? Were they all Nugentwitnesses?

does that justify, in any way, battering a
woman to the stage of permanently disabling her?

No, it does not. But if your nose had been broken in an assault, you
might be even more irrational than you normally are.

*IIRC She was sitting in
her car when the vicious attack occurred

"punched the motorist responsible when she went to see how he was."

and the cyclist was described as
of 'athletic build'

Where? I do not see that in the article.

Why did the cyclist not wait for the Police, nor call
them himself? *It is just a great pity that other drivers did not detain him
at the time.

Perhaps they sympathised with him? They were the witnesses quoted, I
assume.

Since the woman was not charged with any driving offences it seems likely
that there was no damage to her car to support any allegation that she
knocked him off.

Because normally motorists face the full rigour of the law, don't
they? As Firth screams, its only lycra-clad scum who are let off.

This was another example of an arrogant cyclist thinking he could get away
with bad riding and assault due to his anonymity.

Or
This was another example of an arrogant motorist thinking she could
get away
with dangerous driving and assault due to her physical and legal
armour.

He did the wrong thing, but I cannot say that I might not have been
tempted to assault in response to a perceived attack. (If the
assailant were small enough).

Permanently?
Wikipedia:-
"Perforation of the eardrum leads to conductive hearing loss, which is
usually temporary."

I expect that "whiplash" may also have resulted.
Motorists suffer from it a lot, but the brave types don't usually
bother the NHS to treat it.

Why do you attempt to divert attention from the violent nature of the case?

There is no mention of whiplash.

The reported case details stated that it was a 'permanent impairment' and
that was what he plead guilty to, so do you consider wikipedia to know more
about her case than her doctors?

Either way, it was a cowardly attack by a fit man on a woman, and I notice
you do not have an opinion to give on that.
