A motorist driving in the opposite direction recalled Allitt’s vehicle travelling towards him at speed moments before the collision, adding that he thought the driver was starting to drift over into his lane. Upon hearing a crash, the person stopped and found Keeler lying face down in the road.

After examining debris, police tracked Allitt’s car to his home in Aldenham, arresting him at 1.25pm the following day.

In a statement, Allitt’s then partner said they had been out to Radlett and then St Albans to celebrate a friend’s birthday.

She said Allitt had drunk alcohol, but did not appear overly drunk. She also said she was aware he had taken cocaine.

After telling police he initially believed he had hit an animal, Allitt said he had returned to the scene in the morning and realised this was not the case.

He told police he had drunk three to four bottles of beer. A blood test confirmed he had used cocaine and cannabis. Allitt said he had not taken cocaine that night, but had done so the evening before.

The report is flawed in several ways (as is usually the case with
road.cc's typically semi-literate contributors, all of whom seem to have
little knowledge of the legal system). In particular, whilst a "judge"
is mentioned, there is no reference to the court involved. So was this
the Hertfordshire Crown Court (with judgement of guilt at least
potentially and notionally falling to a jury), or was it (say) St
Albans' Magistrates' Court (with the judge being what used to be called
a Stipendiary Magistrate, with responsibility for determining the
question of guilt)?

I tend to agree with (some of) the more sensible BTL commentators, as
well as with one of Collins' remarks. Twenty years' imprisonment for
causing a death whilst drugged up - on anything illegal - seems
reasonable. That surely counts, in the mind of any rational person, as
criminally reckless as well as simply being an egregious criminal
offence, irrespective of whether a collision takes place. After all, it
doesn't matter to the deceased victim and their family whether the death
is caused through the medium of a motor vehicle, a knife, a firearm, a
ligature, a box of matches and some accelerant or a bicycle.

But the basis of the charge here was "careless driving", which in the
exact circumstances - facilities incapacitated by the undisputed use of
illegal drugs - seems a very charitable one to bring. "Death by
dangerous" (treating all illegal-drug affected driving as dangerous
driving per se) might well have been an entirely proper charge.

The judge described the cause as "more than momentary inattention",
which in this context, means "more than careless driving". How could it
not be?

There was no alcohol-related charge, presumably because any test
administered - especially the next day - would have been "negative" (ie,
not a high enough result). This was all down to the drugs, and ought to
be a salutary lesson to any idiot who wants illegal drugs decriminalised.

You could have just said 'I agree with Mike Collins'.


Such a statement would have been substantially untrue.

I do NOT agree that illegal drugs should be normalised. This case well
illustrates part of the reasoning for that.

Quite so. Taking drugs and driving, like drinking (to excess) and
driving, or cycling along a footway, through a red traffic light or

After examining debris, police tracked Allitt’s car to his home in Aldenham, arresting him at 1.25pm the following day.

In a statement, Allitt’s then partner said they had been out to Radlett and then St Albans to celebrate a friend’s birthday.

She said Allitt had drunk alcohol, but did not appear overly drunk. She also said she was aware he had taken cocaine.

After telling police he initially believed he had hit an animal, Allitt said he had returned to the scene in the morning and realised this was not the case.

He told police he had drunk three to four bottles of beer. A blood test confirmed he had used cocaine and cannabis. Allitt said he had not taken cocaine that night, but had done so the evening before.

He admitted causing Keeler’s death by careless driving when over the prescribed limit.

Jailing Allitt and banning him from driving for four years and four months, Judge Michael Simon said: “For reasons unclear, you did not see him in his high visibility jacket, with his lights and reflectors on. You could not have been in any doubt of the seriousness of the accident.(SIC)”

Describing Allitt’s driving as, “more than momentary inattention,” the judge added: “It was utterly irresponsible behaviour in failing to stop. Despite the deployment of the airbags and damaged windscreen and you failed to report what had happened even though you walked past the scene the next morning.

“Nothing Mr Keeler did contributed to the collision. The responsibility for his death is yours alone.”

What was "careless" about taking the drugs and then driving?
It was a deliberate act.

Quite so. Taking drugs and driving, like drinking (to excess) and
driving, or cycling along a footway, through a red traffic light or
riding a bicycle not fitted with brakes or lights, is a deliberate action..


So you agree using cannabis in moderation is acceptable.
