The driver was not proven to be eating 5 secs before he hit the cyclist. At 30 MPH thats a decent gap and time to react. The cyclist had no lights or reflectors. Had the cyclist lived, I would have tried to find a way to sue him for causing an avoidable accident and something to do with mental distress. Dunno what, but I would have tried to go after him. I live on the Olympic cycling route in surrey, and since the Olympics, cyclists have been a damn dangerous plague. For the record, I and my kids are cyclists. -- AC |

Do you have to celebrate every cyclist that gets killed? For my money anyone eating, reading maps newspapers or texting whilst driving is guilty of careless driving if they only hit street furniture or barriers and dangerous driving if they kill or injure someone. -- Regards, Martin Brown |

The thread title above and several previous posts of yours here like your recent distasteful "cyclist killed = good result for motorist". Do you know what time this accident happened? Around local sunset!!!! It was still plenty light enough. I would have a lot more sympathy for the driver if it was pitch black and the cyclist had no reflectors or lights. It is a stupid to cycle without lights or reflectors but I don't believe it makes any difference if the driver isn't looking. It appears to have been a failure in police evidence about the weather conditions and road situation at the time of the crash that allowed this "I can eat and drive pillock to get off the more serious charge". http://road.cc/content/news/90037-dr...driving-guilty The guy was eating and *NOT* paying attention to the road ahead and should undoubtedly have been convicted of *DANGEROUS* driving.
